It is common knowledge that a growing number of judges, lawyers, scholars and laymen are seriously proposing the complete elimination of the jury system, at least in civil cases. Considerable opinion has already been expressed for dispensing with even the court trial in automobile negligence cases, and many litigants are severely criticizing the bench and bar for the large expenditures of both time and money and delays in the trial of lawsuits associated with jury trials. It is expedient, then, that we examine our old practices in the light of modern needs if we are to preserve our present court system, including jury trials. . . .
