Eastern Washington Growth Management Hearings Board

On Tuesday, November 19th at 10am until noon, the Eastern Washington Growth Management Hearings Board will be in the Barbieri Courtroom to conduct a Hearing on the Merits in the case of Futurewise, Spokane Riverkeeper, The Lands Council, and Trout Unlimited, Spokane Falls Chapter v. Spokane County and the Washington State Department of Ecology, case number 13-1-0003c. Petitioners challenge numerous provisions in the Spokane County Shoreline Master Program, which was approved earlier in 2013 and was the first revision of the SMP in forty years.

The Growth Management Hearings Board is a quasi-judicial panel created specifically to address the unique needs of Washington State’s Growth Management Act RCW 36.70A. Its focus is to hear disputes that arise from uncontrolled city and county growth that may result in potential threats to the environment; sustainable economic development; and the health, safety, and quality of life of Washingtonians.

Petitioners invite all of the students of Gonzaga Law School to attend the hearing, as well as anyone from the public that you believe may be interested. Oral argument will be conducted for the Petitioners by Rick Eichstaedt, Executive Director of the Center for Justice in Spokane; and Tim Trohimovich, Director of Planning and Law of Futurewise in Seattle. For the Respondents, Alexander Mackie from Perkins Coie and David Hubert, Deputy Prosecuting Attorney in Spokane will represent Spokane County; and Sonia Wolfman, Assistant Attorney General will represent the Department of Ecology.

Please arrive promptly prior to 10am; if it is necessary for you to leave before noon, please do so at an appropriate moment between arguments. Both Petitioners and Respondents will each have 45 minutes to present their arguments with an addition 10 minutes allotted for Petitioners’ reply to Respondents’ argument.
